Komisja Europejska wyraziła poważne wątpliwości co do zgodności działań firmy Meta, macierzystej spółki Facebooka i Instagrama, z przepisami Unii Europejskiej dotyczącymi reklamy i ochrony danych osobowych. Kluczowym punktem kontrowersji jest model, który, zdaniem Komisji, narusza unijne zasady cyfrowe.

Meta oferuje użytkownikom swoich platform wybór między płatną wersją bez reklam a darmową, ale z personalizowanymi reklamami. Komisja Europejska uważa, że taki model nie daje użytkownikom prawdziwej możliwości wyboru usługi, która wykorzystuje mniej danych osobowych, ale jest równoważna pod innymi względami. W wyniku wstępnego dochodzenia, Komisja stwierdziła, że model ten nie pozwala użytkownikom na swobodną zgodę na przetwarzanie ich danych osobowych.

Procedura w toku

Brukselski organ zaznacza, że dochodzenie jest nadal w toku, a jego wstępne ustalenia opierają się na sprawie przeciwko Meta, wszczętej w marcu. Meta ma teraz możliwość przeanalizowania zgromadzonych materiałów i odpowiedzenia na nie na piśmie.

Od marca firmy działające w sektorze cyfrowym muszą przestrzegać ustawy o rynkach cyfrowych (DMA). Jej celem jest zapewnienie większej konkurencji i lepszych warunków dla nowych rywali na rynku cyfrowym. Przepisy DMA mają na celu ograniczenie dominacji dużych platform, takich jak Apple, Amazon, Microsoft, Alphabet i Meta, które Komisja określa jako „strażników” rynku.

Możliwe konsekwencje

Komisja planuje zakończyć dochodzenie w ciągu roku. W zależności od wyników, firmy objęte dochodzeniem będą musiały podjąć odpowiednie kroki, aby rozwiać obawy regulatora. W przypadku nieprzestrzegania prawa, Meta może zostać ukarana grzywną w wysokości do 10% całkowitych obrotów globalnych. Dla firm wielokrotnie łamiących przepisy, kara może wzrosnąć do 20%.

Komisja Europejska podkreśla, że jej działania mają na celu zapewnienie przestrzegania przepisów chroniących konsumentów oraz stymulowanie zdrowej konkurencji na rynku cyfrowym. Sprawa Meta jest jednym z pierwszych poważnych testów nowych przepisów DMA i może mieć daleko idące konsekwencje dla przyszłości regulacji dużych platform internetowych w Europie.
